Question by Tony: What is an Unintentional Tort scenario in Law that follows all of the ABCD test?
For my legl210 class, we have to come up with scenario that follows the ABCD test in law.
A) someone owes a duty of care
B) someone breaches the duty of care
C) the breach causes an injury (causation)
D) it causes injury or harm (damages)
The scenario should be pretty general but it has to have all 4 parts included in it. It also has to be an unintentional tort (the event occured accidently and unintentionally) (something like stealing or killing someone on purpose doesnt count, thats an intentional tort)
What can my scenario be?

These are the elements for a negligence cause of action. Think of a car wreck.
A) The driver owes a duty of care to drive safely.
B) The driver is texting while driving, thereby breaching that duty
C) The driver's lack of attention causes him to crash into another car
D) Injuring the other driver
